Opening a Short-Term Rental in Italy

A practical roadmap for foreign and Italian property owners: how to classify the activity, identify the correct regional or municipal filing, complete national requirements and avoid advertising the property before it is legally ready.

Opening a short-term or tourist rental in Italy is not completed by obtaining the CIN alone. The procedure normally starts with the rules of the Region, the Municipality and, where relevant, the local SUAP.

The exact filing, terminology and supporting documents depend on the location of the property, the type of accommodation and whether the activity is carried out privately or as a business.

1. There is no single opening procedure for all of Italy

Italian national law sets several common obligations, but tourism and accommodation rules are also regulated at regional and local level. A procedure accepted in one Region may be incomplete in another.

Depending on the location and classification, the opening step may be called:

  • a communication for tourist rental;
  • CIA or another commencement notice;
  • SCIA submitted through the municipal SUAP;
  • registration in a regional or provincial tourism database;
  • a combined online procedure incorporating more than one of these steps.

Do not copy another owner's procedure

Always verify the rules for the municipality where the property is physically located. The owner's residence or nationality does not determine the competent local authority.

2. First classify the activity correctly

Before filing anything, establish what legal category applies. The most common distinction is between a simple rental of a residential property and an accommodation business offering organised hospitality services.

For the tax regime governing short-term rentals, Italian rules presume business activity when more than four apartments are allocated to short-term rental during the same tax year. This threshold does not remove the need to assess the facts of each case and any stricter regional classification rules.

3. Check that the property can be used

Before submitting the opening communication, verify at least:

  • the lawful planning and cadastral status of the property;
  • habitability or other applicable occupancy requirements;
  • minimum surface, hygiene, ventilation and occupancy standards;
  • the permitted number of guests and beds;
  • any condominium rules affecting the use of common areas or signage;
  • local restrictions, zoning rules or special municipal authorisation regimes;
  • the title allowing the applicant to rent the property, such as ownership, usufruct or a valid subletting right.

Ownership does not guarantee tourist-rental eligibility

A property can be owned legitimately but still present planning, occupancy, condominium or local-law issues that must be resolved before guests are hosted.

4. Complete the regional or municipal opening filing

The owner or operator must identify the competent portal and submit the procedure required by the Region, Province or Municipality. In many areas, this step creates or activates the property in the local tourism database.

Identify the competent authority

Check the Region's tourism website and the municipality's institutional or SUAP portal.

Select the correct category

Choose non-business tourist rental, business rental or the appropriate accommodation category.

Prepare the supporting documents

These may include identification, tax code, property data, floor plan, title of possession and declarations concerning legal requirements.

Submit and retain the receipt

Keep the protocol number, submission receipt and every attachment or declaration sent.

Obtain the local identification code

Where provided, the regional or provincial code is normally issued before or alongside access to the national CIN process.

Wait for the procedure required locally

A filing may have immediate effect, require validation or depend on later registration. Do not assume that merely starting an online form authorises publication or guest stays.

5. Business activity and SCIA

A person carrying out short-term or tourist rentals as a business must submit a SCIA — Segnalazione Certificata di Inizio Attività through the SUAP of the municipality where the activity is carried out.

Business operation may also require:

  • an Italian VAT number;
  • registration with the Business Register;
  • social-security registration where applicable;
  • certified email and digital-signature tools;
  • additional municipal or regional documentation.

SCIA is not the same as the CIN application

The SCIA concerns commencement of a business activity. The CIN is the national identification code. Where both apply, completing one does not replace the other.

6. Complete the national requirements

Obtain the CIN

After completing the preliminary local or regional procedure, request the National Identification Code through the Ministry of Tourism's BDSR. The CIN must be displayed outside the building and included in advertisements.

Install the required safety devices

Residential units used for tourist or short-term rental must comply with the national safety requirements, including functioning combustible-gas and carbon-monoxide detectors and compliant portable fire extinguishers, subject to the applicable rules and any permitted technical exceptions.

Separate local and national codes

The CIN does not automatically replace regional, provincial or municipal identification codes. Display both where the applicable rules require them.

7. Requirements before hosting the first guest

The opening filing is only part of the compliance process. Before the first arrival, organise:

  • tourism statistics: access to the regional or provincial reporting system;
  • tourist tax: municipal registration, collection procedures, exemptions and periodic declarations where applicable;
  • rental documentation: appropriate contract or written booking conditions;
  • tax records: receipts, platform statements, withholding documents and income records;
  • privacy information: compliant handling of guests' personal data;
  • advertisements: correct CIN and any required local code, capacity and legally required information.

Guest registration is a public-security obligation

Platform booking data does not replace transmission through Alloggiati Web. The operator remains responsible for identifying guests and reporting them within the statutory deadlines.

8. Practical issues for foreign owners

Foreign ownership does not exempt a property from Italian regional, municipal, public-security or tax obligations. Some online procedures require an Italian tax code, digital identity, certified email or a locally recognised delegate.

Before starting, a foreign owner should establish:

  • whether an Italian tax code has been correctly issued and associated with the property;
  • which digital credentials are accepted by each portal;
  • whether a professional delegate can file the procedure;
  • who will manage guest identification, statistics and tourist tax locally;
  • how Italian rental income will be declared and how any platform withholding will be reconciled.

Can I obtain the CIN before filing with the Region or Municipality?

Normally, the property must first be correctly registered through the applicable local or regional procedure so that it can be identified in the BDSR.

Does every private owner need to submit a SCIA?

Not necessarily. National law expressly requires SCIA for business short-term or tourist rentals, while non-business opening procedures depend on regional and local rules.

Can I start advertising immediately after submitting a communication?

Only when the applicable procedure has become effective and all advertising requirements, including the CIN and any local code, have been met.

Is an Airbnb listing sufficient to start the activity?

No. Registration with a booking platform does not replace filings with Italian authorities or public-security, statistical, tourist-tax and tax obligations.

Can a property manager complete the opening procedure?

Often yes, if properly authorised and accepted by the relevant portal. The owner should retain the delegation and verify who remains legally responsible for each obligation.

Does the four-apartment threshold apply to every legal issue?

No. It creates a national presumption of business activity for the short-term rental tax regime. Other facts and regional rules may lead to a business classification even below that threshold.

Do I need Alloggiati Web before the first booking?

You need an operational way to report guests before hosting them. Apply early because accreditation and credential issuance may require time and documents.

Can the same opening procedure be used in every Italian Region?

No. Forms, names, portals, supporting documents and deadlines vary. Always use the procedure applicable to the property's location.
